Family will appeal court decision on settlement over shocking photos
A Knox County girl who saw her father’s fatal drunken-driving accident photos in a school presentation will appeal a court’s decision revoking a financial settlement paid to her as a result of the incident.
Moriah Higginbotham, now 18, and mother Marla Higginbotham plan to submit paperwork this week to the Tennessee Supreme Court.
“I’d just like to see justice done,” Moriah Higginbotham said Monday. “You can’t take back what happened and me having to go through this. The only thing you can do is to make sure something like this would never happen to anyone ever again.”
In April 2010, a Knox County Circuit Court judge ruled that the city of Knoxville must pay $66,700 to the family. The Higginbothams found out earlier this month that the state appellate court had overturned the judgment.
